Terms of use

These terms are the agreement between you and Plot studio when you use it. By signing in or making a garden you agree to them. If you do not, please do not use the service.

The service

Plot studio lets you draw a plan of a garden over an aerial photo, view it in 3D, publish it, and invite other people to edit or view it. It is free to use. We may change, limit or stop any part of it, and we set limits on how much one account can make (for example, how many gardens, uploads and saved revisions).

Your account

You sign in with an emailed link, so keep your email account secure: anyone who can read your mail can sign in as you. Use an address that is yours, and do not sign in as someone else.

Your gardens are yours

You own what you draw, write and upload. You give us permission to store it, copy it as needed to run the service (revisions, backups, thumbnails), and show it to the people your garden's visibility setting allows — everyone, anyone with the link, or only the people you invite. If you ask for quotes, you also give us permission to share that garden's plan as described below. That permission ends when you delete the garden or your account, apart from copies already shared with your consent.

Only upload images you have the right to use, and do not upload anything unlawful, or anything that reveals other people's private information without their permission.

Plans are not surveys

Aerial photos can be months or years old and a few feet out of place, and measurements drawn on them are estimates. A plan from Plot studio is not a survey, an engineering drawing or professional advice. Before you dig, build or plant, check boundaries, slopes and drainage on site, and call 811 (Dig Safe in Massachusetts) to have underground utilities marked.

Asking for quotes

If you ask for quotes and agree to sharing, we pass your plan and contact details to up to 3 local landscape companies we believe to be reputable. Asking is free for homeowners. The companies are independent businesses, not our employees or agents: any quote, contract, payment, warranty or dispute is between you and them. We do not guarantee that any company will reply, quote, or do the work well, so check licences, insurance and references as you would for anyone. You can withdraw at any time by writing to mark@visualboston.com.

Landscape companies who are given access to a homeowner's plan may use it only to prepare a quote for that homeowner, must not share it further, and must stop contacting the homeowner if asked.

Fair use

Do not use Plot studio to break the law, to send spam, to harass anyone, to get at other people's gardens or accounts without permission, to overload or probe the service, or to scrape it with automated tools. We may remove content or close accounts that do, and may act on reports from others.

No warranty

Plot studio is provided as it is and as available, without warranties of any kind, to the fullest extent the law allows. We work to keep your gardens safe and backed up, but we cannot promise the service will always be available or that nothing will ever be lost, so keep your own copy of anything important (the Share dialog can print the plan or download it as a file).

Limits on liability

To the fullest extent the law allows, Plot studio and its operator are not liable for indirect or consequential losses, for lost data, or for work done on the strength of a plan, and our total liability for anything to do with the service is limited to $100. Nothing here limits rights you have that the law does not allow to be limited.

Ending

You can stop using Plot studio at any time and ask us to delete your account (see the privacy notice). We may suspend or close an account that breaks these terms. If we ever close the service, we will try to give notice so you can download your plans first.

Changes

We may update these terms. The date at the top says when they last changed; if a change matters, we will tell you when you next sign in. Using the service after a change means you accept it.

Law

These terms are governed by the laws of the Commonwealth of Massachusetts, and any dispute will be heard in the state or federal courts located in Massachusetts.
